MOO Referral Program Terms and Conditions

By participating in the MOO Referral Program (Program), you confirm your agreement to these terms and conditions (Terms) in full. You may not participate in the Program if you are prohibited to do so by any applicable laws or regulations.

MOO Print Ltd and its subsidiaries (MOO) may, from time to time, offer existing MOO customers the chance to refer others. We reserve the right to terminate the Program at any time for any reason. We also have the right to modify or amend these Terms and the way rewards are earned at any time, and to disqualify any person from participation if they do not comply with any of these Terms.

1. PRIVACY

To participate in the Program, you must provide personal information about yourself and the individual or business you're referring, such as name and email address. This personal information will be collected, processed, and used in accordance with MOO's Privacy Policy.

2. REFERRAL TERMS

2.1 Eligibility

To be eligible, a Referrer must be a legal resident of the United States, United Kingdom, the European Union, Canada, or Australia and be at least 18 years old.

2.2 Becoming a Referrer

When you refer a friend, family member, or colleague, you become a Referrer. Subject to these Terms, you'll get a unique referral link (Personal Link) that allows you to receive either a discount code for Qualified Friend Referrals (Discount) or a stated value on a prepaid card for Qualified Business Referrals (Reward). Personal Links are only for individuals.

Referrers must honor the spirit of the Program by only referring to real people who meet these Terms. You cannot refer yourself. For example, you can't create multiple or fake accounts or use multiple or fake email addresses or identities to participate.

2.3 Verification

The issuance of a Discount or a Reward is subject to verification. MOO may delay a Discount or Reward for the purpose of investigation. We may also refuse to verify and process any transaction that we, in our sole discretion, believe to be fraudulent, suspicious, in violation of these Terms, or which may impose potential liability on MOO or its affiliates. All of MOO's decisions are final and binding, including but not limited to decisions as to whether a Qualified Friend Referral or Qualified Business Referral, Discount, or Reward is verified.

2.4 Email Consent

By you submitting the email address(es) of a friend, family member, or colleague, you warrant and represent that you have their prior consent for MOO to contact them in relation to the Program.

3. REFER A FRIEND PROGRAM

3.1 Qualified Friend Referral

A Qualified Friend Referral must meet all the following conditions:

The referred individual must have completed a purchase of a Product(s) using your Personal Link. If they use any other link or method, it will not count as a Qualified Friend Referral;
The referred individual must not already be a registered MOO customer under any email address or alias; and
The referred individual must be a legal resident of the United States, United Kingdom, European Union, Canada, or Australia and must be at least 18 years of age.

Only one Qualified Friend Referral can be earned for each referred individual.

3.2 Discounts

A Discount can only be awarded for Qualified Friend Referrals.

3.3 Issuing Discounts

The Referrer will receive a unique discount code by email for each verified Qualified Friend Referral after the Qualified Friend Referral places their first paid order. This code can be used for purchases of MOO's products on our website. All details will be provided in the confirmation email sent to the Referrer.

The Qualified Friend Referral shall be able to use the Discount immediately upon accessing the Personal Link from the Referrer.

3.4 Discount Code Value

Discounts and discount codes shall have no monetary value and cannot be redeemed for cash. They are not transferable and cannot be auctioned, traded, bartered, or sold. If the Program is terminated, any unredeemed discounts or codes will be void. MOO may specify certain products that are ineligible for payment with a Discount or discount code.

4. REFER A BUSINESS PROGRAM

USERS IN THE USA: The total Rewards for making Qualified Business Referrals in the USA by a Referrer in one calendar year is capped at $600. Any referrals made that would exceed this cap will not qualify as a Qualified Business Referral and will not be processed.

4.1 Qualified Business Referral

A Qualified Business Referral must meet all the following conditions:

Completes the referral form provided via the Referrer’s Personal Link. Use of any other link or method won't count as a Qualified Business Referral;
the referred business subscribes to a MOO Business Services (MBS) account;
the referred business subscribing to an MBS account must be a corporation (with a state registration number), or a registered sole proprietorship or equivalent;
completes a purchase for Product(s) with a minimum order value of $400 (excluding taxes, shipping, and discounts); and
the purchase is carried out by a person who is i) a legal resident of the United States, United Kingdom, European Union, Canada, or Australia, and ii) is at least 18 years old.

Only one Qualified Business Referral can be earned per referred business.

4.2 Payments

Payment of the Reward can only be awarded for Qualified Business Referrals.

4.3 Issuing Rewards

The Referrer and Qualified Business Referral will, depending on their location , each receive either a unique Visa® or MasterCard® Prepaid Card after the Qualified Business Referral signs up for an MBS account and has placed their first order. All details will be provided in an email to the Referrer and each Qualified Business Referral.

4.4 Reward Value

Rewards have a maximum monetary value, as stated in the email with the details of the Reward. They are non-refundable and cannot be redeemed for cash.

5. LIABILITY

5.1 By Participating, You Agree...

By participating in the Program, you agree:

To be bound by these Terms, MOO's decisions, the MOO Privacy Policy and MOO website Terms and Conditions.
That MOO and its affiliates shall not be liable to you, in accordance with clause 5.2 below.
To be contacted by MOO via email in relation to the Program and for the purposes set out in the MOO Privacy Policy.

5.2 MOO Is Not Liable For...

MOO shall not be liable for any:

Late, lost, stolen, or misdirected communications, regardless of the method of transmission.
Computer hardware or software malfunctions, lost connections, or transmission errors.
Data corruption, theft, or unauthorized access to or alteration of materials.
Losses or damages resulting from accepting, possessing, or using a Discount or Reward that were not reasonably foreseeable to MOO.
Printing, typographical, administrative, or technological errors.
Claims, demands, and damages in disputes among users of the Program.
Damages or losses arising or resulting from:

Your use, participation or inability to use or participate in the Program.
The cost of procuring substitute goods and services related to the Program.
Unauthorized access to or alteration of your data or transmissions.
Statements or conduct of any third party on or through the Program.
Any other matter relating to the Program.

You use the Program at your own risk. To the fullest extent permitted by law, MOO disclaims all liability, including but not limited to damage to any computer system caused by participation in the Program. We reserve the right to cancel, modify, or suspend the Program if a virus, bug, or other causes beyond our control corrupt its administration, security, or proper running. MOO is not liable to you for failing to supply any Reward or Discount for reasons beyond our control.

6. CONDUCT

6.1 Prohibited Conduct

You agree not to use the Program to:

Violate applicable law.
Infringe on MOO's or any third party's intellectual property rights.
Stalk, harass, or harm another individual.
Collect or store personal data about other users.
Impersonate any person or misrepresent your identity.
Interfere with or violate the Terms or another user's use of the Program.
Resell, barter, trade, or auction access to the Program to generate income.

6.2 Bulk Distribution/Spam

If you send a Personal Link by email, the email must be created and sent in a personal manner that is customary for communications with friends, colleagues, and family. By submitting their email addresses, you are representing that you have the third party’s prior consent. Bulk email distribution, distribution to strangers, or any other promotion that would be considered "spam" at MOO's sole discretion is strictly prohibited and may result in immediate termination of your account and deactivation of your Personal Link. We have a no-tolerance spam policy. You agree to comply with all applicable law, including anti-spam laws. Any non-compliance will result in you indemnifying MOO for any costs it incurs as a result.

6.3 Fraudulent and Suspicious Behaviour

MOO may prohibit you from participating in the Program or receiving a Discount or Reward for any reason, including (but not limited to) if we determine you are trying to undermine its fairness, integrity, or legitimate operation. The use of any automated system, script, or macro is strictly prohibited and will result in disqualification from the Program. You cannot enter with multiple or fake emails or accounts, use fictitious identities, or use any system, bot, or other device to participate. We reserve the right to disqualify any User and/or cancel any Discount(s) or Reward(s) if we find you are tampering with the entry process or violating these Terms.

CAUTION: Any deliberate attempt to damage or undermine the legitimate operation of the Program may be a violation of criminal and civil laws and will result in disqualification. MOO reserves the right to seek legal remedies and damages to the fullest extent of the law, including criminal prosecution.

7. RIGHTS OF USE

MOO grants you a revocable, non-transferrable, non-sublicensable, non-exclusive right to access and use the Program solely for your personal, non-commercial use.

8. GENERAL TERMS

8.1 Entire Agreement

All terms, conditions, and definitions from the MOO Website Terms and Conditions and MOO Privacy Policy are incorporated by reference into these Terms as if they were fully set forth here. These Terms, along with the MOO Website Terms and Conditions and MOO Privacy Policy, constitute the entire agreement between you and MOO regarding your use of the Program.
In the event of a conflict between the document in clause 8.1a above, the following order of precedence shall apply (ranked from highest to lowest):
1. these Terms;
2. MOO Website Terms and Conditions; then
3. MOO Privacy Policy.

8.2 Other Provisions

If any provision of these Terms is found by a court to be invalid, the parties agree that the court should try to give effect to the parties' intentions, and the other provisions of these Terms will remain in full force and effect. Employees of MOO or its affiliates, and those living in the same household, are not eligible to participate.

9. DEFINITIONS

In these Terms:

Discount means a discount code for Qualified Friend Referrals.
Personal Link means the unique referral link provided to a Referrer.
Product means the MOO products available for purchase from time to time.
Program or MOO Referral Program means the opportunity to refer others to use MOO for the purchase of Product(s).
Qualified Business Referral means a referred business that meets the conditions outlined in section 4.1.
Qualified Friend Referral means a referred individual who meets the conditions outlined in section 3.1.
Referrer means an individual who refers a friend, family member, or colleague to MOO.
Reward means the value on a prepaid card for Qualified Business Referrals.
Terms means these MOO Referral Program Terms and Conditions.
